GIVEAWAY - OFFICIAL RULES ELIGIBILITY: THE HOSS’S GIVEAWAY (“Giveaway”) IS OPEN ONLY TO LEGAL RESIDENTS OF VIRGINIA, WEST VIRGINIA, MARYLAND, OHIO AND PENNSYLVANIA WHO ARE 18 YEARS OF AGE OR OLDER AS OF THE DATE OF THEIR ENTRY. You may only enter once per day. To qualify for a prize, participants must complete Sponsor’s online Guest Satisfaction Survey. Alternatively, participants must complete and return an official entry form. Employees of the Sponsor, its affiliates, subsidiaries, parent company, agencies, and those living in the household of the same are not eligible to enter or win. Void where prohibited or restricted by law.HOW TO ENTER: Beginning on July 1, 2008, you may enter by completing the Hoss’s Guest Satisfaction Survey at www.hosss.com. In order to complete the survey, you must enter the 16-character survey code located on your guest receipt, and follow the online instructions for the survey. Survey participants who complete the survey will be automatically entered in the giveaway for the calendar quarter in which the survey is completed. ALL SURVEY PARTICIPANTS MUST COMPLETE THE SURVEY NO LATER THAN JUNE 30, 2009. Alternatively, you may obtain an official entry form by sending a self addressed, stamped envelope to: Attention: GIVEAWAY, Hoss’s Corporate Office, 170 Patchway Road, Duncansville, PA 16635. Provide all information required on the official entry form and return it to: Attention: GIVEAWAY, Hoss’s Corporate Office, 170 Patchway Road, Duncansville, PA 16635. ALL MAIL-IN ENTRIES MUST BE RECEIVED NO LATER THAN JUNE 30, 2009. Reproductions of official entry forms are not allowed. Only one mail-in entry is allowed per envelope and each envelope must be mailed separately. WINNER SELECTION: At the end of each calendar quarter during the program, one winner will be randomly selected from among the participants who entered during that quarter (“Quarterly Winner”). Quarterly Winners will be selected in the following manner. All qualifying entries collected during the quarter will be combined and a single entry will be randomly selected for that quarter’s Cash Drawing. No person may win more than a single Cash Prize in a 12-month period. Each Quarterly Winner will be notified by telephone and/or overnight mail on or about two days after each cash drawing and will be required to execute and return a notarized Affidavit of Eligibility and Release of Liability and Publicity within seven calendar days (including holidays) of attempted notification prior to claiming any prize. Failure to return required documents within seven calendar days (including holidays) from attempted notification will result in the Quarterly Winner being disqualified and an alternate Quarterly Winner will be randomly selected from among that quarter’s qualifying entries. If any prize is unavailable for reasons beyond the Sponsor’s reasonable control, such prize will not be awarded. All Federal, state and local tax liabilities are the responsibility of the winner. Acceptance of the prize constitutes permission (except where prohibited) to use the winner’s name, likeness and statements for publicity purposes without additional compensation or limitation. PRIZES: Four (4) Quarterly Winners will receive a cash prize of One Thousand ($1,000.00) Dollars (“Cash Prize”). The odds of winning a Cash Prize depend on the number of qualified entries received during the relevant drawing period. No prize substitution, assignment or transfer of any prize by a winner is permitted. GENERAL: By entering this Giveaway, participants agree that Sponsor shall not be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in the Giveaway or acceptance of or use or inability to use a Prize or parts thereof, including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damages to or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Quarterly Winners release the Sponsor from any and all liability and responsibility with respect to each Prize (including any property loss, damages, personal injury or death). Quarterly Winners acknowledge the Sponsor has neither made nor is in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to any Prize. The Sponsor, its affiliates, subsidiaries, parent corporation, and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively, “Releasees”) are not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network; mail delivery; theft, tampering, destruction, or unauthorized access to or alteration of entries; entries that are processed late or incorrectly or are incomplete, illegible or lost due to any other reason whatsoever; typographical, printing or other errors; mutilated, misdirected or undelivered entries; or any cause or causes beyond the control of Sponsor to award the Prizes, or any combination of any of the foregoing. Incomplete and illegible entries (determined in Sponsor’s sole and absolute discretion) will be disqualified. All entries become the property of Sponsor and will not be acknowledged or returned. False, fraudulent or deceptive entries or acts shall render entrants ineligible. By entering the Giveaway, entrants affirm that they have read and accepted these Official Rules. The information obtained from the entry will be used by Sponsor and its affiliates. The laws of Pennsylvania apply to and govern this Giveaway and any claims must be raised and resolved in the Federal or state courts located in the courts of Pennsylvania, United States. If for any reason, this Giveaway is not capable of running as planned, or if tampering, unauthorized intervention, actions by participants, fraud, technical failures, or any other causes, in Sponsor’s sole discretion, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Giveaway, Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in any such action and/or to cancel, terminate, modify, or suspend this Giveaway or any portion thereof. In such event, some or all of the Prizes may not be awarded in Sponsor’s sole discretion. WINNER’S LIST: |
